The interplay between the Americans with Disabilities Act (ADA/ADAAA), the Family and Medical Leave Act (FMLA), and state workers’ compensation laws creates one of the most complex compliance challenges for employers — and, by extension, their legal counsel. Each law is intricate on its own, but their overlap can trigger significant legal risks, from inconsistent leave decisions to costly litigation.
This CLE program will equip attorneys with the knowledge to advise clients on questions such as:
- What constitutes a “serious health condition” under the ADA versus the FMLA?
- Who is entitled to protections under the ADA/ADAAA, and how is that determination made?
- How do state workers’ compensation laws interact with federal leave obligations when an employee is out on FMLA or ADA leave?
