About This Course

This CLE course explores the nuances of estate planning with clients who may be experiencing cognitive decline, focusing on the legal standards for capacity, the ethical duties of attorneys, and best practices to prevent and defend against undue influence claims.

Attorneys will learn how to assess capacity ethically, document client intent thoroughly, and structure estate plans that withstand future legal challenges. The course also reviews how courts evaluate undue influence, and provides tools for strengthening the enforceability of estate documents.

Attendees will leave with a clearer understanding of how to protect both client autonomy and the integrity of the estate planning process.
