Artificial intelligence is rapidly transforming software development, with tools such as ChatGPT, GitHub Copilot, Claude, Cursor, Lovable, Bolt, and other AI-assisted coding platforms becoming commonplace in startup and enterprise environments. While these tools can dramatically increase development speed, they also raise important legal questions involving copyright ownership, open-source licensing obligations, patent protection, software due diligence, and investor scrutiny.

This CLE will provide attorneys with a practical framework for identifying and managing the intellectual property and licensing risks associated with AI-generated software. The program will examine ownership of AI-assisted code, copyleft and open-source license exposure, software supply-chain governance, due diligence expectations in venture capital and mergers and acquisitions transactions, and emerging best practices for documenting and protecting software assets. Attendees will gain a working understanding of the legal and business issues that arise when AI becomes part of the software development lifecycle.
