About This Course
Artificial Intelligence has moved from a "novelty" to a "standard of care" requirement. This CLE course provides an essential update for practitioners on the rapidly evolving ethical obligations surrounding generative and agentic AI. We will move beyond the basics of "don’t hallucinate" to explore the next generation of risks: agentic AI autonomy, AI-driven billing scrutiny, and the emerging duty of technological competence that may soon penalize lawyers for failing to use AI efficiently.
Participants will review the latest guidance from the ABA (including the legacy of Formal Opinion 512) and key state bar pivots (CA, NY, FL) regarding:
- Confidentiality 2.0: Protecting data in an era of local vs. cloud-based LLMs.
- The Supervision Gap: Managing non-lawyer AI "agents" under Model Rule 5.3.
- Reasonable Fees: Navigating the ethics of "Value-Based" vs. "Hourly" billing as AI slashes drafting time.
