About This Course
This CLE course addresses the reality that it is unfortunately somewhat common for there to be an accident on a construction site, no matter how careful a Contractor or their workers may be. As Attorneys that are involved with Construction Projects, or who have Clients that are, it is essential to understand the legal and practical steps that must be taken when an accident occurs and OSHA becomes involved.
Thie program will discuss what types of accidents are reportable and the applicable reporting timeframes, how to handle an OSHA Site Visit or Investigation, and what rights employers and contractors have during such situations. Participants will also learn what to do if an OSHA Citation is issued, the process for contesting a citation and the very short timeframe for filing such a protest, as well as strategies for handling a protest and the common defenses that may be available. All these and many more basic questions will be answered, providing attorneys with a practical guide to navigating OSHA investigations and enforcement actions in the construction industry.
