Employer vaccination mandates remain a significant area of employment law even after the expiration of most COVID-19 emergency requirements. Litigation arising from the pandemic has clarified the authority of federal agencies, state governments, and private employers to require vaccination, while continuing to shape the law governing religious and medical accommodations, employer liability, and workplace policies. This CLE program examines the legal framework governing employer vaccination mandates, beginning with the constitutional and statutory foundations of public vaccination requirements before turning to private employer policies and federal employment law. Topics include the authority of federal agencies to impose vaccination requirements, the interaction between public and private mandates, state regulation of workplace vaccination policies, evolving standards for religious and medical accommodations, recent trends in vaccination mandate litigation, and vaccine injury compensation. Participants will gain a practical understanding of the current legal landscape and the lessons that recent litigation provides for employers, employees, and their counsel.
