A large number of cases start out "Somebody died, and then..." At that point there are usually three sets of variables in play. There is a Will or there is not. The situation is friendly or it's not. The lawyer is being asked to represent the fiduciary or someone affected by the fiduciary. In New York these matters are handled in Surrogate's Court.
This CLE course addresses the practical aspects of moving cases through Surrogates Court. In this seminar Barry Seidel reviews the various department of Surrogates Court (Administration, Probate, Accounting & Misc.), as they apply to each of types of cases a lawyer is typically confronted with. Each subject is explored with concrete, real life examples, so the attorney will be fully familiar with the workings of Surrogate's Court and the relationship between the cases and the various departments.
