This CLE course will focus on three recent court decisions. All three concerned applications by developers seeking to remove height restrictions. In each case, community groups filed legal actions demanding that the height restrictions remain in place.

The program will review the urban planning concepts at play in each case, as well as the difficulties involved in challenging city government decisions. In all three cases, the trial court ruled in favor of the community, and the appellate court reversed and ruled in favor of the developer.
