Description

Brokers want to make deals throughout the nation, and chafe at the idea that their single state license will limit their ability or right to legally work on deals in other states.

License portability-which is NOT license reciprocity-will allow this to occur, when the broker cooperates with a licensee of the state where the property is located. However, different states have different limitations on just what these out of state brokers can legally do.

Learn how to find, interpret license law limitations, and counsel your broker clients on what they may do without jeopardizing their right to fees; and their licenses in their home states. The laws aren't as clear as you might have thought.

Lecturer Bio

James A. Hochman, Esq.

James A. Hochman has practiced law for more than 40 years. As senior vice president for CBRE, Inc. for 22 years (1982 – 2004) he counseled all divisions of the world’s largest commercial brokerage and real estate services firm covering 20 states in the central US and Canada. For the last 16 years, he has continued representing real estate brokers in both large and small firms.

His practice includes drafting, enforcing, and litigating to collect brokerage fees, asserting and foreclosing broker liens, and counseling firms and brokers on interstate brokerage and license portability. He is either the drafter or a contributor to most of the 34 broker lien statutes in the US and several of the different statutes on license portability.

He defends license law violation cases, and teaches classes for brokers and for other attorneys. He has also taught real estate courses in the JD and LLM programs at two Chicago area law schools. In addition, Mr. Hochman writes two quarterly columns for the Society of Industrial & Office Realtors. He is a partner at Schain Banks Kenny & Schwartz, who can be reached at 312-345-5756 and at jhochman@schainbanks.com.
