Welcome to CA Agency Law, Part II. To recap, Part I was an overview of federal, state and NCAA regulations that apply to sports agents. We also reviewed current sports agency trends.

In Part II, we’ll now focus on CA Agency Law specifics - definitions, disclosures, representation of pro athletes, contract requirements, “Name, Image & Likeness” changes, protection of college athletes & universities, and civil & criminal penalties for bad acts. We’ll also introduce NFL agency requirements (Athlete-Agent & Player-Team Contracts) which is the focus of CA Agency Law Part III in early 2021.

And finally. We need stories. Stories about ties to organized crime, illicit payments, self-dealing, hiding assets in the Cayman Islands, collusion & extortion. Sports agency is hyper-competitive. To reinforce the stakes involved, in Part II we discuss several notorious incidents of sports agent “bad behavior.” Stories are sticky. And applying these stories is how we as lawyers show clients concrete examples of the penalties for crossing the ethical and fiduciary bright-line in pursuit of a big commission.

Lecturer Bio

Brian Brunkow, Esq.

Brian Brunkow, Esq., is a northwest native and graduated cum laude with a business law focus from Seattle University School of Law. Brian passed the WA Bar in ’01, the CA Bar in ’06, and has worked extensively in regulatory compliance, corporate training, and dispute resolution in Washington and California.

Outside of work, Brian has coached youth & high school football, is a sports parenting author, and speaks at west coast coaching clinics on student athlete development and NCAA athletic recruiting practices. Brian also covers NCAA recruiting compliance and sports agency at his YouTube channel, Zero Offseason.
