The Tax Cuts and Jobs Act made changes to the transfer tax regime that were few in number but great in importance. The foremost change was the increase of the lifetime coupled estate and gift tax exemption to approximately $11.4 million per person, opening up myriad tax planning possibilities for the high net worth and ultra-high net worth. Perhaps equally important was what the TCJA did not change: the annual gift and GST tax exemption regimes, the Section 1014 basis adjustment, and the portability rules among them.
