About This Course
Conflicts of interest remain one of the most complex and critical challenges in the ethical practice of law. This CLE course provides an update on identifying, addressing, and managing conflicts in today’s legal landscape. Attendees will explore key issues including: (a) recognizing and handling former client conflicts; (b) obtaining and documenting informed consent to conflicts with current and former clients; and (c) navigating conflicts involving affiliated entities.
The course will highlight recent case law and ethics opinions interpreting and applying the rules governing conflicts, offering practical guidance for avoiding potentially costly missteps. While the Model Rules of Professional Conduct provide a common framework, significant variations exist among states in both the conflict rules themselves and how they are applied. This program will help attorneys understand these nuances, examine real-world examples, and stay current with evolving standards of professional responsibility.
