Daniel Levin, Esq.
Daniel Levin is an Associate Attorney with Frazer & Feldman, LLP in Westbury, New York. The focus of his practice is on students with disabilities, including representation of school districts in CSE meetings and litigation of impartial hearings, review of IEPs and 504 plans, negotiating settlements, and student discipline matters, including superintendent hearings and manifestation determination reviews. He has successfully defended districts in investigations by the U.S. Department of Education’s Office for Civil Rights, State Education Department, and State Division of Human Rights. He also provides counsel to districts on medication administration in schools, residency determinations, immunization requirements, Title IX, and GENDA.
Prior to joining Frazer & Feldman, LLP, Daniel worked as a staff attorney and team leader for the Special Education Unit of the New York City Department of Education (“DOE”), where he investigated, settled and litigated due process complaints. He drafted nearly a dozen appeals to the Office of State Review on special education matters and chaired a committee focused on improving the unit’s litigation practice. As team leader, Daniel supervised attorneys on defending against IDEA claims for settlements and impartial hearings. Daniel also worked as senior counsel and legislative director in the New York State Senate, where he negotiated, drafted and advised state legislators on budget bills, voting rights legislation, criminal law and criminal justice reform, and local government issues.
Daniel received his J.D. from Albany Law School and was the symposium editor of the Albany Government Law Review. He received his B.A. in Political Science from Binghamton University. Daniel is admitted to practice in New York and is a member of the Nassau County Bar Association.
He regularly presents on school law issues that are of importance to educators, board members, and attorneys, including to the National Business Institute, Practicing Law Institute, Nassau County Bar Association, New York State School Boards Association, the Nassau-Suffolk School Law Conference, and professional development training for district staff. He has had articles published by the New York State School Boards Association, and National School Board Association on assumption of risk, criminal and civil liability for school district administrators, and When Does FAPE End for Students with Disabilities?
