About This Course
Female Genital Mutilation (FGM), sometimes referred to as female circumcision, presents unique legal, evidentiary, and credibility challenges in asylum litigation. This CLE program provides a comprehensive overview of FGM-based claims before USCIS asylum offices and the Executive Office for Immigration Review (EOIR), drawing on extensive, real-world litigation experience.
The course covers the core legal framework governing FGM claims and walks practitioners through the development of a strong case, including the effective use of country conditions evidence, expert reports, corroborating documentation, and client testimony. Particular attention is given to identifying common pitfalls, evidentiary gaps, and vulnerabilities that can undermine otherwise meritorious claims.
The program also examines how to anticipate and respond to Department of Homeland Security defenses—both well-established and emerging—and offers practical strategies for strengthening advocacy in these complex and highly scrutinized cases. Designed for immigration practitioners at all experience levels, this session equips attendees with actionable tools to more effectively litigate FGM-based asylum claims.
