About This Course
This CLE program provides a detailed, practice-oriented examination of two increasingly complex areas of legal ethics: attorney withdrawal and fair jury selection. Tailored for litigators and trial counsel, the course analyzes the tension between a lawyer’s duty of confidentiality and the need to provide sufficient information to support a motion to withdraw, particularly in situations involving client misconduct, nonpayment, or breakdowns in the attorney-client relationship. Participants will review governing professional conduct rules, relevant case law, and strategic considerations when courts demand greater disclosure than ethics rules may comfortably permit.
The program also addresses the evolving legal and ethical constraints on jury selection, with a focus on the prohibition against discriminatory use of peremptory challenges. Through discussion of recent developments, participants will examine how courts are scrutinizing race- and gender-based strikes, the evidentiary burdens associated with challenges, and the risks of both intentional and implicit bias during voir dire.
Throughout, the course emphasizes practical, defensible approaches to navigating these issues in active litigation. Attorneys will gain concrete guidance on balancing zealous advocacy with ethical compliance, managing client and court pressures, and minimizing exposure to sanctions, reversals, or disciplinary action.
