About This Course
This CLE course examines the evolving landscape of DUI defense litigation with a focus on Illinois law while comparing key procedural and constitutional differences across jurisdictions. Attendees will learn how mandatory dash-camera recording laws, field sobriety testing challenges, motions practice, breath-test defenses, and pretrial litigation tactics can significantly alter case outcomes. The program also explores strategic considerations surrounding Petitions to Rescind Summary Suspension, motions to quash arrest and suppress evidence, and the increasing importance of video evidence in Fourth Amendment litigation.
In addition to pretrial motion practice, the CLE will provide practical guidance on client counseling, collateral consequences, discovery strategy, use of experts in medically based defenses, and trial preparation techniques. Special attention will be given to Illinois-specific procedures and seminal cases such as People v. Patel and Trainor, while also highlighting nationwide trends and comparable defenses available in other states. Participants will leave with litigation strategies, motion concepts, and courtroom techniques that can immediately be implemented in DUI defense practice.
