About This Course
This CLE program examines alternative methods for transferring real property to designated beneficiaries while avoiding probate upon the owner’s death. The program will provide an overview of Transfer on Death Deeds under New York law, Lady Bird Deeds, also known as Enhanced Life Estate Deeds, as used in Florida, and the use of traditional Life Estates in transferring real property. The course will address the requirements and mechanics of each method, as well as their potential benefits, limitations, and practical considerations.
The program will also explore issues and concerns attorneys should evaluate when using these tools, including potential complications that may arise when property is transferred outside of the probate process. Attendees will gain practical guidance for assessing these alternatives and determining how they may fit into a client’s broader estate planning objectives.
