About This Course
This CLE program examines the regulatory framework for stablecoins following enactment of the GENIUS Act in July 2025 and its implementation beginning in January 2027. The program provides an overview of stablecoins and their growing use in areas such as cross-border payments, remittances, and corporate treasury management, before examining the Act’s core requirements governing issuance, reserve assets, redemption rights, disclosures, and regulatory oversight.
The program also explores how the federal framework will interact with existing state regulatory authority. While the GENIUS Act preserves state licensing, examination, and enforcement powers, it establishes a “substantially similar” standard that states must meet, raising important issues involving reserve requirements, attestations, examinations, and coordination among regulators. The presentation considers the practical implications for both regulators and industry participants as they prepare for the new requirements.
Finally, the program addresses key developments to monitor through January 2027, including federal rulemaking, state implementation efforts, the substantially similar certification process, and evolving regulatory and examination practices. Particular attention is given to the legal and operational issues that attorneys advising stablecoin issuers, financial institutions, businesses, and regulators will need to consider during the transition.
