Mechanic’s and Construction Liens are a powerful tool to secure monies due to contractors and others who provide labor and materials to improve real property. This course will provide an exhaustive discourse on the use of mechanic’s and Construction liens on both public and private improvements, as well as the steps that owners may take to respond to the liens. Brian J. Markowitz, Esq. and Max Rayetsky, Esq. will begin by discussing general principles of the Lien Law, and will proceed with an examination of work covered, alienable property, enforcement and defense, and other items of import. They will conclude by addressing trust funds and foreclosure proceedings.

Lecturer Bios

Brian J. Markowitz, Esq.

Mr. Markowitz focuses his practice on construction disputes, construction contract drafting and negotiation, commercial litigation, real estate litigation and complex commercial litigation. Mr. Markowitz represents property owners, developers, construction managers, general contractors and design professionals in all phases of litigation, from case inception through trial or alternative dispute resolution and appeals, in matters involving mechanics’ lien foreclosures, delay claims, extra work disputes, defaults and wrongful termination claims, trust fund claims, surety and insurance issues design defect claims, adverse possession claims, license agreements, adjacent landlord issues, and coop/condo disputes.

He has extensive experience in all aspects of contract drafting, negotiation and review, including drafting, negotiating and reviewing construction management and general construction agreements, architectural and engineering agreements, construction access and license agreements, consulting agreements and subcontracts.

Max Rayetsky, Esq.

Max Rayetsky concentrates his practice in commercial litigation, construction litigation, real estate litigation, and commercial leasing and transactions.

On the litigation end, Max prosecutes and defends mechanic’s lien claims, extra work and contract balance claims, delay and consequential damages claims, wrongful termination and termination for convenience claims, and other types of cases arising in a construction dispute. On the transactional end, Max negotiates and drafts construction agreements, design agreements, consultant agreements, and license agreements.

Prior to joining Goldstein Hall, Max worked at a construction litigation boutique law firm servicing the real estate and construction industries.

Max received his J.D. from St. John’s University School of Law, during which he worked as a law clerk at various private and public sector legal jobs. He earned his undergraduate degree from Fordham University, where he was a recipient of Dean’s List awards, a member of the National Political Science Honor Society (Pi Sigma Alpha), and an active participant in the school’s Mock Trial team.
