Estate and Elder Law Practitioners face a variety of unique ethical questions in their daily work. The law concerning fiduciary duties goes back centuries, if not more, and is enshrined in the common law.

Whether it is the executor, agent of a power of attorney, trustee, or guardian ad litem, the obligations of loyalty, good faith, fair dealing and honesty must be adhered to. Challenging and novel questions arise in this field very often.

This program will explore who can serve as a fiduciary, the specific duties, and to whom the duties are owed, which may not always be clear given a complicated set of facts. Next, what are the limits of the duties and what activities are forbidden? Answering these questions might not always be clear cut.

This CLE course will try to take a utilitarian and practical approach to understanding the role of fiduciaries and bring up some real world examples to provide a practitioner with strategies and tips to avoid ethics issues.

Lecturer Bio

Barry E. Janay, Esq.

He is an attorney practicing for 17 years with a JD and an MBA and has a growing practice in estates and trust and probate and administration law. He has also incorporated his passion for aviation into his law practice and has a growing practice area in aviation law. Finally, he has taken a lot of the skills and knowledge he obtained in marketing and has created a legal marketing platform for trust and estates lawyers which we are developing connections and customers hopefully to one day have customers in all 50 states.

Representing and counseling small to medium sized businesses in matters relating to employment and labor law, commercial collections, copyright, trademark, defamation, privacy and other media law matters, as well as complex commercial litigation and intellectual property transactions. Acting as primary outside counsel for clients in field ranging from publishing, software, retailers, consumer products, and online information businesses.

He has received his JD from: Golden Gate University School of Law Juris Doctorate and MBA, 2003
