Navigating The Hospital Licensing Act’s Important and Broad Exception to the Petrillo Doctrine

Section 6.17(e) of the Hospital Licensing Act created a broad and important exception to the Petrillo doctrine. Since 2000, defense counsel representing a Hospital could speak ex parte with any agent, employee or medical staff member of the hospital. However, more than 15 years after that legislation was enacted, attorneys and judges far too often are unaware or disbelieving of this rule regarding these communications.

This CLE presentation will examine the rules in place before the HLA, explain the current lay of the land for Hospital defense counsel, and discuss the important nuance of the general rule.

Lecturer Bio

Joseph E. Comer, Esq.

Mr. Comer concentrates his practice in civil litigation with an emphasis on medical malpractice defense of health care institutions, physicians, and nurses. His prior experience also includes municipal liability defense, real estate transactions and appellate practice.

Mr. Comer is an Adjunct Professor at the DePaul University College of Law where he teaches Legal Analysis Research and Communication III.

Mr. Comer was admitted to the Illinois Bar in 2010 and to the U.S. District Court, Northern District of Illinois in 2011. He is a member of the Chicago Bar Association and the Illinois State Bar Association.

Mr. Comer received his law degree from DePaul University College of Law in 2010. While at DePaul, he served as President of the DePaul Moot Court Society and was inducted into the Order of the Barristers, a national honors society for oral advocacy. He received his B.A. from the University of Missouri-Columbia in 2006.
