Litigating International Child Kidnapping Cases Under the Hague Convention

This CLE is designed to teach attorneys how to represent clients in federal and state court using the Hague Convention on the Civil Aspects of International Child Abduction and the implementing legislation, known as the International Child Abduction Remedies Act. Litigation under this treaty and its implementing legislation is a variant of civil litigation that is unique and outside the normal experience of even veteran family law attorneys and federal litigators, as well as many federal and state court judges. A whole set of special rules have been fashioned by the treaty, the implementing legislation and court decision, all designed to carry out the purpose of the treaty and to put the United States in sync with its treaty partners in dealing with the emotional and highly charged issues surrounding international parental kidnapping.

Cases that are litigated in the United States always involve the left behind parent or guardian as the petitioner with the respondent being the other parent or another person located in the United States. The treaty and the implementing legislation calls for expedited handling of these cases, hopefully avoiding undue expense and resulting in quick resolution.

This CLE is of being offered to educate and in the hope that the attorneys who have an interest in handling one or more of these cases will join the list of attorneys whose names are provided by the State Department to parents outside the United States seeking legal counsel to recover their children.

Lecturer Bio

Patrick H. Stiehm, Esq.

Patrick H. Stiehm is in solo practice, in the District of Columbia, under the name Stiehm Law Office. His major areas of practice are domestic and international commercial finance and representing the left behind parent in international child kidnapping cases in both state and federal court, throughout the United States. He has brought Hague Convention cases, that have furthered the purposes of the Convention and refined the law governing the Convention here in the United States, typical examples of which are Escaf v. Rodriquez, 200 F. Supp. 2d 603, (Eastern District of Virginia, 2002) and Ly v. Heu, 294 F. Supp. 2nd 1026 (District of Minnesota, 2003).

Mr. Stiehm is a former District Attorney (Wisconsin), SBA District Counsel (Phoenix Arizona and Washington, DC) and General Counsel of a publicly traded commercial finance company. He has been an instructor in the United States Attorney General's Trial Advocacy Course, and a CLE Instructor, in the areas of litigation, commercial finance and international parental child kidnapping in and/or accredited by: Arkansas, Alaska, Arizona, California, Georgia, Kentucky, Hawaii Illinois, Missouri, North Carolina, New Jersey, New York, Ohio, Rhode Island, South Carolina, Tennessee, Washington State, Pennsylvania, Virginia, Minnesota, North Dakota, South Dakota, Iowa, and Wisconsin.

He has been a featured speaker on legal matters at various trade meetings and seminars involving the commercial finance industry. He has also authored articles in various commercial finance trade publications and in legal publications, including an article for foreign lawyers on Hague Convention practices in the United States.

His undergraduate degree is from the University of St. Thomas in the twin Cities of Minneapolis and St. Paul. His JD is from the University of Minnesota Law School. He is licensed to practice law in Virginia, Maryland and Minnesota.
