Sometimes unfortunate things happen without a warning. If we do not plan ahead and if we do not assist our clients to plan ahead, the consequences are dire. This CLE will help attorneys’ better assist clients in preparing for the unexpected, starting with a Health Care Proxy, a Will and ultimately Power of Attorney (POA). If these things are not in place, and the parents of a child die, or an adult becomes incapacitated, a Guardianship petition is necessary. This CLE will also assist in determining which Guardianship applies to the various cases presented.

Florentina Nica, Esq.

Ms. Florentina Nica is a founding partner of Voicu & Nica, P.C. She has broad knowledge, expertise, and sensitivity to the firm’s clients and their unique needs. Ms. Nica’s practice focuses on general liability/personal injury, real estate, wills & trusts, immigration and family law. Ms. Nica is an attorney admitted in New York State, U.S. District Court for the Southern District of New York and U.S. District Court for the Eastern Districts of New York.

In 2016 and 2017, Ms. Nica was selected as a Super Lawyers – Rising Star. She also received the “10 BEST 2016 & 2017 Client Satisfaction” award by the American Institute of Legal Counsel.

Before becoming a founding partner of Voicu & Nica P.C., Ms. Nica gained legal experience by representing insurance companies and self-insured clients in all areas of tort litigation, including but not limited to, personal injury resulting from automobile, premises, products and general liability, long-term care & elder law, medical and legal malpractice, toxic tort, asbestos litigation, no-fault, worker’s compensation, uninsured/underinsured motorist claims and insurance coverage issues.

Ms. Nica worked for a national, full-service law firm with approximately 900 attorneys and 28 offices in 14 states and the District of Columbia, which offered legal experience in more than 35 specialties. She interned for a large international law firm in their medical malpractice team, representing hospitals, physicians, diagnostic laboratories and blood banks in negligence and wrongful death cases on behalf of insurance carriers.

Ms. Nica clerked for the NYS Supreme Court, Appellate Division, Third Judicial Department, Committee on Professional Standards, investigating inquiries concerning the professional conduct of attorneys who are admitted to practice, reside, have an office in, are employed, or transact business in the Third Judicial Department. Received Juris Doctor from Albany Law School of Union University in 2008.
