Description

The widespread use of internet communications by attorneys in advertising and with clients requires a re-examination of the ethical rules. The course will examine attorney's speech, what lawyers can and cannot say on a website, in personal and professional blogs and on social networking sites, as well as other ethical issues including setting and collecting fees, privilege and confidentiality and proceedings before the Disciplinary Board.

Topics Covered include:

  • attorney's speech - on line, about judges, to and about opposing counsel
  • attorney fees - contingent fees, engagement agreements, fee collection practices
  • confidentiality and attorney client privilege
  • conflicts of interest, disqualification of attorney or firm
  • common causes of disciplinary action against attorneys
  • process and procedure before the Disciplinary Board

Lecturer Bios

Justin T. Papciak, Esq.

Justin is an associate in the Pittsburgh law firm of Feldstein Grinberg Lang & McKee, P.C. where he focuses on both civil and criminal litigation. Justin practices in both the Pennsylvania state and federal courts. Prior to joining the firm, he served as an Assistant District Attorney in Washington County, Pennsylvania. He has prosecuted numerous misdemeanor and felony offenses, including hundreds of DUI cases. His experience with prosecuting DUI cases ranges from advising law enforcement as to the initial charge to suppression hearings and, ultimately, trial. Justin also served a member of the Appellate Practice Section where he authored briefs for review by the Pennsylvania appellate courts. He also served as a judicial law clerk where he was introduced to a wide variety of civil and criminal matters. Justin earned his BSBA in Finance from the University of Pittsburgh in 2005. Prior to entering law school, Justin worked in the Private Wealth Management Section of Mellon Bank (now BNY Mellon). He earned his Juris Doctorate from the Duquesne University School of Law in 2009. During law school, Justin was Executive Comment Editor of the Duquesne Business Law Journal. He also gained practical experience as a judicial extern and represented individual investors as a student-attorney through the Duquesne Securities Arbitration Practicum.

Francis C. Rapp, Esq.

A shareholder at Feldstein Grinberg Lang & McKee, Frank Rapp has been with the firm since 1988. Frank is a trial lawyer with emphasis on commercial litigation, white collar criminal defense, construction law, and medical malpractice. A graduate of Duquesne University, Frank earned his J.D. in 1982 and was the Executive Managing Editor of Law Review in 1981-1982. He is a member of the Pennsylvania and Allegheny County Bar Associations, American Association for Justice, National Association of Criminal Defense Lawyers, Pennsylvania Association for Justice, Pennsylvania Association of Criminal Defense Lawyers, and Academy of Trial Lawyers of Allegheny County. Frank has volunteered as a child advocate and was one of the original Career Mentors with the CLAAY Program at Oliver High School. He was also an advisor to the high school’s mock trial program, which went to the State Finals in 2004. Frank is a board member of The Academy of Trial Lawyers of Allegheny County, ACH Clear Pathways, which provides low cost visual and performing arts programs to urban at-risk youth, and is the President of the St. Thomas More Society. Frank is currently an Adjunct Professor at Duquesne University’s School of Law, teaching trial advocacy.
