Crafting a Case: Openings and Summations

While a case is proven by the facts in evidence, a trial attorney’s opening and closing statements are often the most critical elements in their success. Developing a compelling opening and summation must begin early in the process with the facts then interwoven into that central theme. This CLE course will teach you how to use the frame of the opening and closing statements to prove your case, bolster the facts which support it and deflect those that weaken it. The course includes a dynamic back and forth with famed attorney Ben Brafman and a Harvard Law School professor which will serve to illustrate the course theme.

Lecturer Bios

Benjamin Brafman, Esq.

Benjamin Brafman is the principal of Brafman & Associates, P.C. law firm located in Manhattan. Mr. Brafman’s firm specializes in criminal law with an emphasis on White Collar criminal defense.

Mr. Brafman, a former Assistant District Attorney in the New York County District Attorney’s Office, has been in private practice since 1980. Mr. Brafman is a Fellow in the American College of Trial Lawyers and was selected by New York Magazine as the “Best Criminal Defense Lawyer in New York.” He is also the recipient of the “first” ever Clarence Darrow Award for Distinguished Practitioner by the New York State Association of Criminal Defense Lawyers.

Mr. Brafman has represented a wide range of high-profile celebrities, business leaders, lawyers and professionals in major criminal cases throughout the country including most recently the NY Giants superstar Plaxico Burress and former IMF Chief Dominique Strauss-Kahn.

Alex Spiro, Esq.

Alex Spiro, Esq. has been an Attorney at Brafman and Associates in New York City since July 2013. Mr. Spiro has handled an array of complex litigation and internal audits and investigations. Prior to his joining Brafman, from September 2008 to July 2013, Mr. Spiro worked for federal and state law enforcement, most recently as a Manhattan Prosecutor. Mr. Spiro served as the Director of an autism children's program at McLean Hospital, Harvard's psychiatric hospital. Mr. Spiro has been a Director of Imation Corp. since August 26, 2015. He has been published and has lectured on a variety of subjects related to psychology and the law. Mr. Spiro is a graduate of the Harvard Law School where he remains on the adjunct faculty.
