Tracee Davis
Tracee E. Davis is a senior associate in the commercial litigation group at Zeichner
Ellman & Krause LLP. At ZEK, Ms. Davis handles both federal and state court cases
involving matters ranging in complexity: from commercial business disputes to consumer
and lender’s liability class actions to disputes involving complex structured refinancing
transactions.
She is a graduate of Montclair State College and of American University, Washington
College of Law, where she earned her law degree.
Prior to joining Zeichner Ellman & Krause LLP, Ms. Davis served as the Principal Court
Attorney to Justice Charles E. Ramos of the New York State Supreme Court,
Commercial Division in Manhattan. During her five years with Justice Ramos, Ms. Davis
assisted in managing the resolution of more than 400 complex commercial cases. She
researched and wrote court opinions, many of which were published, and negotiated
case settlements on panoply of business and commercial issues. Some of the cases
she handled included consumer fraud class actions, unfair competition and employment
contract disputes, and conflicts arising from private investment/financial arrangements.
She also served an Adjunct Professor of Law at New York Law School. Ms. Davis
lectured at Education Unlimited for several years to real estate salespersons on the laws
regulating commercial and residential real estate transactions.
Ms. Davis is currently a Delegate to the New York State Bar Association’s House of
Delegates, the immediate past Secretary of the New York State Bar Association’s
Commercial and Federal Litigation Section and since 2001 has been a member of the
Section’s Executive Committee. She also served as Co-Chair of the Section’s State
Court Counsel Committee.
Ms. Davis is also a member of the Association of the City Bar of the City of New York
and member of the Association’s State Court of Superior Jurisdiction Committee.
In 2004, she was also appointed Director of the Independent Judicial Screening Panel,
New York County Democratic Party (Civil Court 2004) to oversee the merit-based
screening and selection process for reviewing applications and identifying qualified
candidates.
Ms. Davis has chaired or served as a faculty member of a number of programs for the
NYSBA, the Association of the City Bar, the New York County Lawyers’ Association, and
the Anti-Bias Committee of the New York State Supreme Court, New York County.
Richard L. Spinogatti, Esq.
Richard Spinogatti is a senior counsel in the Litigation Department. Rich has more than 40 years of experience in federal and state courts in New York and other jurisdictions across the nation. In addition to litigating, trying cases, and arguing appeals at all levels, he has advised national and international clients in connection with internal investigations and represented them in civil and criminal investigations, in administrative proceedings before federal, state and local government agencies, and before industry regulatory organizations.
Through his extensive representation of international, national, regional and local accounting firms, Rich has developed a broad knowledge of accounting, auditing and related professional services, and the complex regulatory structure governing the accounting profession. Rich is frequently called upon to consult with accountants and other professionals in pre-litigation contexts to avoid or minimize exposure risks. He has lectured and taught seminars for partners and employees of accounting firms on subjects ranging from accountants' liability to litigation support.
Rich also has represented issuers, purchasers and sellers in litigation relating to securities transactions, major law firms in malpractice litigation, a major defense contractor, several large manufacturing companies, investment banking organizations and other financial institutions, as well as numerous corporate officers and directors.
Rich has tried numerous civil and criminal cases involving complex commercial transactions, including a broad spectrum of alleged violations of federal and state securities laws, consumer protection statutes, and the accountancy laws in various jurisdictions, as well as common law claims.
Rich is a frequent author of published articles relating to the securities laws, corporate governance and the accounting profession. He is the author of The Liability of Accountants to Non-Clients For Professional Malpractice, published by the Bureau of National Affairs.
Richard T. Farrell
Professor Farrell, a member of the faculty since 1964, is a leading authority on the New
York Civil Practice Law and Rules. He is the author of the latest edition of the
preeminent New York evidence treatise Prince, Richardson on Evidence (11th ed. 1995;
2005 Supplement). He is also a frequent lecturer across the state for bar association and
trial lawyers programs speaking on developments in the law of evidence and civil
procedure. Professor Farrell has argued numerous appeals before the United States
Supreme Court and New York's highest court, and was formerly the Reporter for the
New York Pattern Jury Instructions Committee. He also served as a Law Clerk to Judge
John Scileppi of the New York State Court of Appeals.
Jay G. Safer, Esq.
Jay G. Safer is a partner at the law firm of Wollmuth Maher & Deutsch LLP in New York City. Jay is both a litigator and an arbitrator,
Jay has for many years handled complex litigation in the United States and abroad. Jay represents clients in matters concerning contracts, antitrust, securities, RICO, qui tam, FCPA, international litigation and arbitration, including application of the New York Convention and enforcement of foreign judgments and arbitration awards, banking, financial institutions, corporate governance, technology, privacy, insurance, construction, real estate, labor and employment, product liability, health care, professional ethics, financial, constitutional, and regulatory issues, mediation, class actions, defamation, and media. Jay also counsels clients on commercial matters including, protection and preventative measures and pre-litigation analysis. He has represented clients in international litigation, including domestic and foreign clients in courts outside the United States and foreign clients in the U.S. courts.
Jay has extensive ADR experience both as an arbitrator and as an advocate. He has engaged in numerous arbitrations and mediations and in teaching and speaking at ADR programs. As an arbitrator, he has served in numerous arbitrations involving complex commercial and business matters in various industry areas both as a single arbitrator and as Chair and member of a Tribunal panel. These have included arbitrations administered by various ADR organizations, ad hoc arbitration, and under various rules and laws. He is on the Roster of Neutrals of the AAA for U.S. arbitrations and on the Roster of the AAA’s ICDR for international arbitrations. He is a Fellow of the Chartered Institute of Arbitrations (CIArb) and teaches and trains international arbitrators. As an advocate, Jay has represented clients from the United States and around the world in arbitrations.
His ADR experience has involved a wide range of U.S. and international arbitrations, mediations, and enforcements of arbitration awards including disputes involving contracts, mergers and acquisitions, sales of businesses, investments, energy, healthcare, sales of equipment from U.S. companies to governmental entities abroad, telecommunications, corporate governance, dispute among shareholders, real estate, construction claims, oil and gas leases, insurance, labor and employment, fraud, and entertainment agreements. Jay is both a speaker and teacher on U.S. and international arbitration.
Jay is a Lecturer at Law and Adjunct Professor at Columbia Law School and Fordham Law Schools teaching foreign lawyers and LLM candidates American litigation practice and the management of U.S. Litigation, and the role of arbitration and mediation in U.S. proceedings. Jay was appointed to the Advisory Group to the New York State Federal Judicial Council consisting of federal and state judges appointed by the Chief Judge of the State of New York and the United States Court of Appeals for the Second Circuit. Jay was appointed by the Chief Judge of the State of New York to the Commercial Division Advisory Council that advises the Chief Judge and the Judiciary on matters involving the Commercial Division of the State of New York. He was also appointed by the New York State Chief Administrative Judge to serve on the New York State Advisory Committee on Civil Practice.
Jay has served on panels, bench-bar forums, and is a member of committees with judges and attorneys discussing and speaking on a wide range of civil litigation and dispute resolution issues, litigation and arbitration skills, and U.S. and international arbitration and international litigation practice. He has for many years presented numerous programs and seminars in the U. S. and around the world on U.S.and international litigation and arbitration to U.S. and foreign judges and lawyers. He frequently presents webinars and CLE programs to national audiences.
Jay is involved in leadership positions in numerous bar associations, including as past chair and present member of many bar association sections, executive committees, and committees.
Jay has made appearances on television and authored numerous articles and publications.

Sarah Jo Hamilton
Ms. Hamilton received a B.S.F.S. from Georgetown University and a J.D. degree from
St. Johns School of Law. Currently, she serves as Executive Director, Office of
Character and Fitness, New York Supreme Court Appellate Division, First Department.
Ms. Hamilton has served as a member, Committee on Professional Responsibility, The
Association of the Bar of the City of New York, and member, Committee on Professional
Discipline, New York State Bar Association. A member of the New York Bar, Ms.
Hamilton is a frequent lecturer.
Roger P. McTiernan
Mr. Treiman received a B.S. degree from Fordham University and an LL.B. from
Fordham University School of Law. Currently, he is Senior Partner at Barry, McTiernan &
Moore, where he specializes in drafting pleadings, making court appearances, preparing
cases for trial, attending trials and evaluating cases. He is admitted to practice before
the United States Supreme Court, as well as the United States District Court, Southern
and Eastern Districts of New York, and the United States Court of Appeals, Second
Circuit. Mr. McTiernan is a member of the New York State Bar Association; New York
County Lawyers’ Association; Brooklyn and Manhattan Trial Lawyers Association
(Treasurer, 1975; First Vice President 1976, Past President and Chairman of the Board,
Executive Secretary); Defense Association of New York (Member, Court Techniques

Harold Lee Schwab
Mr. Schwab has tried more than one hundred product liability and major damage cases
of all types to a verdict throughout the State of New York and in other jurisdictions. He
has tried to a successful defense verdict cases involving claims of defective
automobiles, motorcycles, recreational vehicles, childseats, industrial machinery and
equipment, cranes, electrical equipment, home products, nuclear plant design and
vessel design. He has acted as national coordinating counsel on various product lines
for leading manufacturers. Mr. Schwab is listed in numerous peer-reviewed publications,
has given more than one hundred lectures on trial techniques and products liability, and
has authored numerous articles on evidence, product liability and product liability
prevention.
Robert Kelner, Esq.
Mr. Kelner graduated from Columbia University School of Law, and is a member of the
Bar of the State of New York. He is admitted to the United States District Court,
Southern and Eastern Districts.
Currently, Mr. Kelner is a member of the law firm Kelner
& Kelner, Esqs., specializing in the practice of personal injury, medical malpractice and
products liability law. He has obtained many verdicts in excess of $10,000,000, including
one verdict of approximately $23,000,000 (Martin v. Dellwood) and one verdict in excess
of $36,000,000 (Driscoll v. New York City Transit Authority).
Mr. Kelner has lectured
before virtually all major bar associations in Continuing Legal Education Programs,
including, but not limited to, the New York State Bar Association, New York State Trial
Lawyers Association, Association of the Bar of the City of New York, and the New York
County Lawyers’ Association, where he is Co-chair of the annual Civil Trial Practice
Institute.
In addition, he lectured at Princeton University and Columbia University School
of Law. Mr. Kelner is the author of numerous publications and serves as co-columnist of
the New York Law Journal’s monthly column on Trial Practice.
Robert J. Conway
Mr. Conway received a B.A. degree from Fordham University and a J.D. degree from
Albany Law School Union University. He is currently a partner in Marshall Conway &
Wright, PC, one of the leading insurance defense firms in New York and New Jersey. He
is admitted to the Bar in New York State, as well as admitted to practice in the U.S.
District Court, Southern and Eastern Districts of New York. Mr. Conway is a member of
the American Bar Association, Tort and Insurance Practice Section; Defense Research
Institute; New York State Bar Association, Insurance Negligence and Compensation
Section; New York County Lawyers’ Association; Nassau County Bar Association;

Stephen Gassman, Esq.
Stephen Gassman has been practicing matrimonial and family law for over 30 years, and has garnered a nationwide reputation as a leader in the field. He is one of fewer than 100 trial lawyers nationwide to be designated as a Diplomate of the exclusive American College of Family Trial Lawyers.
A graduate of the University of North Carolina and New York Law School, Mr. Gassman has served as an adjunct professor of law at Touro Law School, as Chair of the Family Law Section of the New York State Bar Association, and as President of the Nassau County Bar Association. He is a Fellow of the American Academy of Matrimonial Lawyers and a member of the Committee on Matrimonial Practice of the Unified Court System of the State of New York. He also serves on the Law Guardian Advisory Panel to the Tenth Judicial District, and as a member of the Judicial Hearing Officer Screening Committee of the Tenth Judicial District.

He is an editor of Fairshare, a monthly matrimonial law publication, and has authored a chapter on the Use of Appraisers in the Valuation of Marital Property, published by Matthew Bender, as well as articles for the New York State Bar Association's Family Law Review. Mr. Gassman has lectured extensively to bar groups and at judicial symposiums on the national, state and local levels. As the founding member of the firm, Mr. Gassman has successfully tried hundreds of matrimonial cases, and settled thousands of cases, throughout his career. In addition, he has served as appellate counsel in the Appellate Division and the Court of Appeals. The New York Post has written that he is regarded as the top divorce lawyer in Nassau County.

Hon. Israel Rubin
Justice Israel Rubin has spent more than 15 years as a Justice on the Appellate Division
of the Supreme Court, First Department. Prior to that time, he served in many judicial
capacities in New York including Administrative Judge of the Civil Court of the City of
New York, Justice of the Supreme Court of the State of New York, Acting Surrogate of
Kings County, Judge of the Civil Court in Bronx County and Assistant Corporation
Counsel of the City of New York in charge of the Penalties Division.
Herbert Monte Levy, Esq.
Herbert Monte Levy is the author of “How to Handle an Appeal,” published by the
Practising Law Institute, the Fourth Edition was published in 1999.
Mr. Levy, a graduate of Columbia College and Columbia University School of Law, was
an Editor of the Columbia Law Review. He has frequently lectured on appellate practice
for the Practising Law Institute, The Association of the Bar of the City of New York, and
the New York County Lawyers’ Association. He was Co-Chairman of the New York
County Lawyers’ Association course on appellate practice on the four occasions it has
been given, in 1975, 1979, 1983 and 1988. He has briefed and argued appeals in both
state and federal appellate courts, at all levels and in many states, and has had
extensive trial experience, particularly in cases destined for appeal. For a number of
years, he was Co-Chairman of the New York County Lawyers’ Association course on
Civil Trial Practice, and continues to appear and lecture in that course. As Staff Counsel
for the American Civil Liberties Union from 1949 to 1956, Mr. Levy supervised hundreds
of appeals.
Mr. Levy has served as a member of the Board of Governors of the Federal Bar
Association of New York, New Jersey and Connecticut (now the Federal Bar Council),
and was formerly Chairman of its Bill of Rights Committee. He is presently a member of
the New York County Lawyers’ Association’s Committee on Practical Legal Education.
He is former counsel to the First Amendment Lawyers Association.
Mr. Levy is the author of various legal articles, including the book length “Justice – After

Elliott Scheinberg, Esq.
Elliott Scheinberg is an attorney whose practice is limited to matrimonial law. He is a Fellow of
the American Academy of Matrimonial Lawyers, and serves on its Board of Managers, New
York Chapter, and as co-chair of the Amicus Curiae Committee and Continuing Legal Education
Committees. He is also a Member at Large, Family Law Section, Executive Committee of the
New York State Bar Association (“NYSBA”) and is co-chair of its Amicus Curiae Committee.
Mr. Scheinberg is the author of five chapters for Matthew Bender Publishing, Civil Action
Matrimonial series. He as also authored “Grandparental Visitation: Its Evolution in New York
State”, published by Benjamin N. Cordozo School of Law. He is published in the NYSBA Family
Law Review on such topics as vacatur of stays, settlement agreements, valuation dates, etc.
Mr. Scheinberg is a contributing author for the New York Law Journal including “The Best
Interest of the Child Test as Applied to Grandparental Visitation” (Nov. 21, 2003), “The Expert’s
Recommendation in Custody Cases” (June 30, 2002), “Expert Testimony as a Backdoor to
Impermissible Hearsay” (July 29, 2004), “People v. Goldstein: The Professional Reliability
Rule and Frye” (Jan. 9, 2006), etc. He has also written several amicus curiae briefs to the
Court of Appeals on behalf of the Academy of Matrimonial Lawyers, several of his arguments
were cited and adopted by the appeals court.
Mr. Scheinberg has lectured for many local and state Bar Associations, the Statewide Appellate
Division Roundtable, the Appellate Division, Second Department, and the Judicial Institute. In
1995, he was honored for his pro bono service by the NCFJE.
David Jaroslawicz
David Jaroslawicz, the principal partner of Jaroslawicz & Jaros, is a member of the New
York, Florida and California bar. He has been in practice for over 34 years and has
secured tens of millions of dollars on behalf of his clients during this time. Mr.
Jaroslawicz has handled both trials and appeals and has argued before the United
States Supreme Court, the New York State Court of Appeals, the United States Court of
Appeals for the Second, Ninth, and Tenth Circuit, as well as the Florida Supreme Court.
Mr. Jaroslawicz has represented countless clients involved in commercial litigation;
contract disputes; real estate litigation; sexual discrimination and harassment, sexual
abuse by priests, medical malpractice; product liability cases such as defective medical
products, pharmaceuticals, bicycle or motorcycle helmets, industrial machinery, tires,
hospital equipment, and defective automobiles, among others. His contributions to the
practice of law have helped shape New York and New Jersey common law. In fact, Mr.
Jaroslawicz was among the legal pioneers who developed the “concerted action” theory
that was utilized against drug manufacturer Eli Lilly Pharmaceuticals, who had
manufactured and sold DES, a drug that caused cancer in children decades after their

cases). In addition to his work in the personal injury field, Mr. Jaroslawicz has also
handled several class-action consumer fraud lawsuits as well as lawsuits on behalf of
stock holders who have suffered severe financial losses as a result of securities fraud
during the dot-com downfall. Due to his expertise, Mr. Jaroslawicz had been invited to
lecture on numerous occasions on behalf of lawyer groups such as the New York Trial
Lawyers Association.
Clifford Aaron
Clifford Aaron has been a litigator in New York State for over 25 years. He began his
career as an Assistant District Attorney in the Bronx County District Attorney’s office,
where he tried over 30 felony cases to verdict. He is currently a partner in the downtown
personal injury firm of London Fischer LLP, where he specializes in insurance defense
litigation, general liability, vicarious liability, and automotive products liability,
catastrophic injury, and complex commercial litigation. His clients include some of the
largest automotive manufacturers in the world, and he has tried numerous personal
injury lawsuits to verdict both in state and federal court throughout New York State. He
has been an adjunct professor of law at New York Law School, and is the former
treasurer of the Products Liability Subcommittee of the Tort Division of the New York
County Lawyers’ Association. He is a member, NYS and American Bar Associations,
Defense Research Institute and NYCLA. Mr. Aaron is admitted to the bar in New York,
U.S. District Courts for the Southern, Eastern and Western Districts of New York and
Tennessee. He received his B.A. degree from Franklin & marshall College and J.D.
degree from Villanova University.
Hon. Barbara R. Kapnick
Born in New York City, Justice Barbara R. Kapnick received her bachelor's degree cum laude from Barnard College and her juris doctor from Boston University School of Law. Between 1980 and 1991, Justice Kapnick worked as a Law Assistant to the Hon. Ethel B. Danzig in the Civil and Supreme Courts of New York County and as Principal Law Clerk for the Hon. Michael J. Dontzin in Supreme Court. Justice Kapnick was elected to the Civil Court in 1991, appointed as an Acting Supreme Court Justice in April 1994 and was elected to the Supreme Court, New York County in 2001. During that time she handled many different Parts, and was assigned to the Commercial Division in
September of 2008. She is a member of the New York State Bar Association, Judicial and Commercial and Federal Litigation Sections, and the New York City Bar, where she has served on numerous committees. She is a Master of the New York American Inn of Court, and is also a past president of the Jewish Lawyers Guild, where she remains active as a member of the Board of Governors. She is also a longstanding member of the New York Women’s Bar Association where she previously served as Co-Chair of the Litigation Committee. Justice Kapnick is a delegate to the Network of Bar Leaders, and sits on the Board of Directors of the Judges and Lawyers Breast Cancer Alert and
the New York State Association of Women Judges. She is also active in the Supreme Court Justices Associations in New York, serving as a Vice President of the Citywide Association. Justice Kapnick, a frequent lecturer for many Bar Associations, has received several awards, including the William Goodstein Memorial Award or Dedicated Service and Leadership from the Association of Law Secretaries to the Justices of the Supreme and Surrogate’s Courts, and
the Benjamin N. Cardozo Award from the Jewish Lawyers Guild. In June 2008, Justice Kapnick was appointed to the Advisory Committee on Judicial Ethics by Chief Administrative Judge Ann Pfau. She also serves as Chairperson of the Board of Trustees of the New York County Public Access Law Library.
Barry Temkin, Esq.
Barry Temkin is a partner at Mound Cotton Wollan & Greengrass. His practice includes securities arbitration and litigation, commodities and securities regulation, legal ethics, professional liability defense, employment and commercial litigation. Mr. Temkin represents broker dealers, financial advisors, insurance brokers and registered representatives in litigation, arbitration and regulatory investigations. He also represents lawyers and law firms in disciplinary investigations, legal malpractice claims and conflict disputes.
Mr. Temkin is an adjunct professor at Fordham University School of Law, where he teaches Professional Responsibility. As an Assistant District Attorney in Brooklyn, he tried dozens of jury cases and served as a Senior Trial Attorney in the Homicide Bureau. Mr. Temkin has published articles on securities law and attorney professionalism in the Georgetown Journal of Legal Ethics, The Securities Regulation Law Journal, Seattle University Law Review, Securities Arbitration Commentator, and the New York Law Journal.
Mr. Temkin has been a member of the FINRA (Financial Industry Regulatory Authority) Board of Arbitrators since 1999, and is co-chair of the New York Country Lawyers' Association Professional Ethics Committee. Mr. Temkin has participated in panels on securities, commodities and legal ethics at the New York State Bar Association, the New York County Lawyers' Association, the Association of the Bar of the City of New York, the Practicing Law Institute, the Futures Industry Association and The Defense Association of New York, along with numerous corporations and insurance companies. He has been quoted in the ABA Journal, the New York Law Journal, The Economist, The Wall Street Journal.com, Law360.com, Lawyers U.S.A. and other publications.
He is a graduate of the University of Pennsylvania Law School and the University of Rochester.
Hon. Richard F. Braun
Richard Braun is a justice for the New York County Supreme Court, Civil Term in the 1st Judicial District of New York. He was elected to this position in 2004, after serving as an acting justice from 1997. His current term expires in 2017.
Hon. Judith J. Gische
Justice Judith J. Gische was born in Queens, New York in 1956. In 1977 she received her undergraduate degree, with honors, from the State University of New York at Buffalo in 1977. She went on to receive her law degree from SUNY Buffalo in 1980.
In October 2012 Justice Gische was appointed and presently serves as an Associate Justice in the New York State Appellate Division, First Judicial Department.
Justice Gische served as a Judge in the Housing Part of the Civil Court of the City of New York, Kings County, between 1990 and 1993. She was elected to the Civil Court in 1994 and reelected in 2004. She was appointed an acting Supreme Court Justice in 1997. She was elected to the Supreme Court in 2009. She presided over dedicated matrimonial parts in both the Bronx and New York County for seven years. For eight years she presided over an lAS Civil Part in New York County.
Prior to her election to the bench, Justice Gische was a Judicial Clerk in the Appellate Division, Third Department from 1980 to 1982 and a senior attorney at Richenthal, Abrams & Moss from 1982 to 1990.
Justice Gische is a member of the New York Chapter of the Women's Bar Association, where she serves as a member of the Board of Directors. She is a member of the New York State Bar Association. She is also a member of the Association of the Bar of the City of New York, where she has served on the Tort Litigation Committee, the Matrimonial Committee, as Chair of the Housing Court Public Services Project, on the Council on Public Service, the Housing Court Committee, and on various Advisory Committees. She is a member of the New York County Lawyer's Association where, she serves on the Judicial Section. She is a member of the New York Association of Women Judges.
Justice Gische has been an Adjunct Professor for the last 10 years at New York Law School. She has also been a featured lecturer, on numerous occasions, at bar and other professional association programs. She has published a number of articles on housing, custody and guardianship issues. She is also a contributing author of the, soon to be released, updated version of the Judges Bench Book.
