In DeMarco v. Stoddard, the Supreme Court of New Jersey held that a medical (podiatric) malpractice policy that was procured via fraud in the application could and should be rescinded ab initio, with the insurer not obligated to defend or indemnify the doctor. In so holding, the Court examined multiple issues, including the background of compulsory malpractice coverage in both New Jersey (where the malpractice occurred) and Rhode Island (where the policy was issued by a state-created entity), choice of law, and reformation, rescission and fraud.

Todd J. Leon, Esq.

Todd J. Leon is a partner in the Princeton, N.J. office of Hill Wallack LLP. He is a member of the firm’s Litigation Division, and its Insurance Coverage, Trial & Insurance Defense, and Product Liability practice groups.

Mr. Leon focuses his practice upon cases involving complex insurance coverage and contractual disputes. He has extensive experience litigating a wide variety of claims at the trial and appellate levels of both state and federal courts.

Mr. Leon is admitted to practice in the State of New Jersey (1998) and the Commonwealth of Pennsylvania (1998), and to the Federal Bars of the United States District Court for the District of New Jersey (1998), the United States District Court for the Eastern District of Pennsylvania (2011), and the United States Court of Appeals for the Third Circuit (2001). He earned his J.D. from Rutgers University School of Law, Camden and his B.A. in English and Political Science from Rutgers College.
