About This Course
Learn effective mediation skills and techniques from a trained practitioner. Whether you are an attorney contemplating starting a mediation practice or are simply looking to gain practical insight into this growing field, this lecture is for you. The first part covers topics which include mediation Do's and Don’ts, the initial interview and substantive areas which may be effectively mediated. This lecture will also give the attorney who is not familiar with Alternative Dispute Resolution (ADR) another model to consider when handling a matrimonial matter. Part two of this program will address a number of ethics issues that can arise in mediation and settlement negotiations. As the field of mediation grows, ethical opinions are needed to guide mediators in their efforts. Some of the questions that arise include: May a mediator represent a former client as an attorney? Is mediation a form of unauthorized practice of law for the non-attorney? How does confidentiality square with the need to share certain information with governmental agencies? How may a mediator guide a couple through the divorce process if they are not fully conversant with the applicable laws governing divorce?
