Much has been discussed about the prosecution and defense in DWI cases. With the advent of the legalization of marijuana more people are driving under the influence of marijuana which is the number one drug used with alcohol while driving at about 27% of time. This is not your mother’s marijuana nor is it a garden variety DWI case. Marijuana and driving cases raise new issues related to all aspects of driving under the influence cases.
Part 2 of this CLE presentation traverses through potential motions in marijuana driving cases related to the standard field sobriety tests which includes studies and reports about their applicability to THC use and THC concentrations and its relationship impairment. It then discusses the trial itself which includes jury selection based upon marijuana use studies and the admissibility of Drug recognition Evaluators and Toxicologists testimony and reports. It concludes with addressing sentencing in marijuana cases including DWI Court eligibility and marijuana use while on probation and parole.
