Description

This lecture touches on a number of issues that an attorney might be presented with in a real estate transaction including what are the ethical implications if an attorney sets up a title agency. Multi disciplinary practice presents a number of ethical issues which will be addressed.

Lecturer Bios

Marvin Bagwell, Esq.

Mr. Bagwell is Vice-President and Chief New York State Counsel for Old Republic National Title Insurance Company and is based in New York City. Formerly, he was the President of Bagwell & Associates Title Agency LLC, a Manhattan and White Plains based title insurance agency. Before then, He was Vice-President and Eastern Divisional Counsel for United General Title Insurance Company. Mr. Bagwell is a 1976 graduate of Harvard College (magna cum laude) and a 1979 graduate of Harvard Law School. He began his practice in Richmond, Virginia with McGuire, Woods and Battle specializing in bond financing and later practiced with Little, Parsley and Cluverius in the same city specializing in public finance law. He later worked as an associate specializing in multi-family bond financing with Hawkins, Delafield and Wood on Wall Street in New York City. Mr. Bagwell began his career in title insurance in 1986 as a claims attorney and underwriting counsel with Title USA, and later advanced to the position of chief or senior counsel for TRW Title, Nations Title and Fidelity Title. Mr. Bagwell is the author of over 70 published articles on real property and title insurance issues. He is a frequent contributor to The New York Journal for which he writes a quarterly article on title insurance. His articles have also been published in the New York Real Estate Reporter and in Settlement Services Today. He is also the editor of the updated section on title insurance in Warren’s Weed, which has just been released. New York State Courts have cited Mr. Bagwell’s articles on at least two occasions. The Court of Appeals cited his article, “New York City Super Liens”, (NYLJ, Land Title Trends, August 9, 1991, p. 1) in Rosenbaum v. City of New York, 730 N.Y.S.2d 774 (2001) and the Appellate Division, First Department, cited “Life Estates-New Legal Gives Title Underwriters Trouble”, (NYLJ, February 11, 2004, p. 5) in Commissioner of the City of New York v. Morello, 779 N.Y.S.2d 61 (2004). Mr. Bagwell is a Past President of both the New York State Land Title Association (“NYSLTA”) and of the Title Insurance Rate Service Association (“TIRSA”). Mr. Bagwell is also a nationally recognized lecturer on title insurance and real property law. He is a certified Continuing Legal Education instructor for Virginia and for Pennsylvania and has served as a lecturer for the City Bar, the State Bar and the Practicing Law Institute. Mr. Bagwell sits on the Executive Board of the Real Property Section of the New York Bar Association and serves as one of the Editors of the Section’s Journal. He was recently elected a Fellow of the American College of Real Estate Lawyers. Mr. Bagwell is licensed to practice law in Virginia and in New York.
