Description

While there are many courses that purport to give a broad overview of electronic discovery, this course is intended as a nuts and bolts approach to preparing to discuss electronic discovery issues at a Rule 26(f) conference, which requires lawyers to discuss electronic discovery issues with their adversaries at the outset of the case. What do I need to ask my client first? How do I go about making sure that a “litigation hold” is in effect? How can I try to negotiate the conduct of electronic discovery in a way that avoids unnecessary expense? How can I best ensure I will get the electronic discovery I need to prove my case? These questions, and similar issues, will be addressed in this course.

Lecturer Bios

Jeffrey E. Gross, Esq.

Jeffrey Gross has practiced in the areas of complex commercial litigation and white collar criminal defense for over ten years. He began his career at Pepper Hamilton in Philadelphia. He next spent more than seven years as an associate and later Special Counsel at Cooley Godward Kronish (and its predecessor firm, Kronish Lieb Weiner & Hellman), until he joined Vandenberg & Feliu in July 2008.
Mr. Gross’s practice includes a wide variety of complex civil litigation, criminal and
regulatory investigations, and corporate investigations. He has represented institutions and individuals in matters involving the antitrust laws, RICO claims, fraud, breach of contract and fiduciary duty claims, and the securities laws. His practice includes the representation of clients in white collar criminal matters and investigations brought by the SEC, FINRA, the New York State Attorney General, and other governmental or regulatory bodies. He has participated in or led monitorships at the behest of the SEC, including an investigation into compliance with rules governing securities transfer activities and the global research analyst settlement. Finally, he has litigated non-compete agreements and misappropriation of trade secret cases.
Representative matters include the prosecution of $500 million fraud claims on behalf of a European bank against two large U.S. banks arising from foreign exchange trading activity, defense of a linen supply company in class actions alleging price fixing and customer allocation in violation of the Sherman Act, representing insurance companies in a $1 billion fraud case concerning surety bonds relating to oil and gas transactions, and defending a former CFO of a telecommunications company from securities and RICO claims arising from the demise of a European joint venture. His pro bono efforts have included obtaining asylum for a political refugee from The Gambia.
Mr. Gross has developed substantial experience with electronic discovery and the recent amendments to the Federal Rules of Civil Procedure. He has published articles about electronic discovery and has given CLE-approved seminars about the emerging law and best practices. Mr. Gross is a member of the Electronic Discovery Committee of the Commercial and Federal Litigation Section of the New York State Bar Association. He is a also a member of the New York American Inn of Court.
He received a J.D. from the University of Pennsylvania Law School in 1998 and served as an Arthur Littleton Legal Writing Instructor during his third year of law school. He graduated with a B.A. in English from the University of Virginia in 1995, where he was elected to Phi Beta Kappa and was an Echols Scholar. Mr. Gross resides in Jericho, New York with his wife and two children. He serves on the Board of Directors of the Birchwood Civic Association.
