Trade Secret Protection is an under-appreciated form of intellectual property protection. This course explains what is eligible for trade secret protection and how to properly define and maintain a trade secret. Licensing issues are mentioned. The Uniform Trade Secrets Act and the U.S. Economic Espionage Act of 1996 are included and discussed. The legally recognizable aspects of software (functions, interfaces, data, etc.) are compared with the different forms of intellectual property protections, explaining how and when to rely on the various legal regimes. Contracts and licensing as well as court decisions grappling with software issues are discussed.
