Concerned about how the workers compensation law is changing – and how your practices may be impacted? This cutting-edge seminar will discuss helpful strategies on defending a workers compensation claim in New York and navigating the complex and changing issues surrounding defenses available to the carrier under the workers compensation law. You’ll gain a clear understanding of lost time awards and permanency, including Sections 15 and 16. You’ll also learn about disability benefits and other lost time awards, the appeals procedures, medical treatments and the employer’s role in workers’ compensation claims.

Lecturer Bios

David A. D’Agostino, Esq.

David A. D’Agostino, Esq., is an attorney with Smith, Sovik, Kendrick & Sugnet, P.C. He earned his J.D. degree from Syracuse University College of Law and his B.A. degree in political science from the University of Pittsburgh. Mr. D’Agostino is admitted to practice in all courts of the State of New York. He is a member of the Onondaga County Bar Association and the New York State Bar Association, Workers’ Compensation Section. Mr. D’Agostino heads Smith Sovik’s Workers’ Compensation Defense Department, in addition to his responsibilities defending general liability and construction matters. Under his auspices, the Workers’ Compensation Department has grown exponentially and continues to grow with some of the biggest corporations in the world as clients.

Kristin L. Norfleet, Esq.

Kristin L. Norfleet, Esq., is an attorney with Smith, Sovik, Kendrick & Sugnet, P.C. She earned her J.D. degree and her M.A. degree in biomedical ethics from Case Western Reserve University, where she was associate editor of the Health Matrix: Journal of Law – Medicine, and her B.A. degree in political science from the University of Rochester. Ms. Norfleet is admitted to practice before all courts in the State of New York and the U.S. District Court for the Northern and Western District of New York. She is a member of the New York State Bar Association, the Onondaga County Bar Association and the Oswego County Bar Association. Ms. Norfleet practices insurance defense to include property damage claims, automobile and premises liability, products liability and construction defects litigation, as well as professional malpractice and workers’ compensation. From 2003 to 2004, she served as the chairperson and principal attorney in the firm’s Workers’ Compensation Department. Ms. Norfleet now assists the department when it needs coverage and defends a number of clients in Section 120 discrimination claims and claims for workers’ compensation death benefits.

David Tallo

David Tallo, with McLane Northeast, is an HR generalist with over 25 years in the transportation and distribution industries. He was involved with the Smith Sovik law firm for 18 years and partnered with them on workers’ compensation case representation, documentation, fraud investigation, fatalities and discrimination claims. He earned a B.S. degree in business from the University of Scranton.
