Despite preliminary instructions from the judge, and the urging of counsel, surveys indicate that a majority of jurors make their decision after opening statements. The opening statement is counsel's opportunity to acquaint the judge and jury with his/her position on the issues intertwined with a road map, or table of contents, of what is expected to unfold during the presentation of evidence.
Edward L. Birnbaum, a prolific author and frequent lecturer on litigation strategy, trial tactics and techniques, oversees the general litigation of the firm. He was admitted to practice in the State of New York in 1964.
